Indian independence of 1947 was the friendly reminder in the history of India that, “All Indians are my brothers and sisters”. This pledge was taken in India by every individual under the umbrella of Indian constitution which was set and stacked in the hearts of every school handouts, diaries, copies etc prior to the commencement of any religious prayer to remind every individual before any religion, cast, creed, tribe, community or any sect to be devout Indian on this motherland to flourish as a first citizen of a dignified life. Wherefore, Article 21 was established to protect, “the life and personal liberty to all persons. It guarantees the right of persons to life with human dignity. Therein are included, all the aspects of life which go to make a person’s life meaningful, complete and worth living.”
In lieu of the above claim ,it was witnessed , a JMI student , slandered not only slandered but defamed under IPC 499 where there can be charges held on, who did character assassination of her reputation , regarding her pregnancy despite the coherent proof of her marital status. She was charged for the part she took in anti-CAA protest and kept in Tihar jail for more than three weeks under the UAPA charges, where her bailed is denied. She had been targeted of hate speech where propagandist took liberty of article 19 clause (1) but forget the other clause which 19 (2) where constitution put reasonable restrictions on the grounds of decency, morality, defamation, incitement to an offence they created in accordance, respectively . Also, two of the students of Aligarh Muslim University exchanged lewd remarks regarding her .Amongst; they were Arjun Chakra Gaur and Nikhil Maheshwari. Whereas, Arjun exploded with satirical comment supporting propagandists as, “YE kudrati biryani kuch jyada explosive nhi ho gae,ab ek saath population explosion na ho jaye,baki sabka test bhi krwaya jaye,bimari ghambheer hai,sb bol rahe they sherniyan dharna pradarshan kr k sanvidhan bacha rahi h per ye toh kuch alg he trah ka pradarshan chal raha tha, Hindustan kisi bhi unislamic activity ko brdasht nhi karega ,enquiry ho baki sbki.” Not only this, another candidate and alumnus of AMU stated, “Pakistan se Hindustan sabhi tukde-tukde gang,leftist,lal salaam,azaadigang aur atankwadion ko bhotbhot mubarakbad. Akhir khaniya kumar mama ban gaye.He barbed a question mocking Kahaniyas support to anti-CAA rally, “ Aye kahaniya kumar tanik bataibo tuhar jeeja kon ba? Leke rahenge azaadi jao di azzadi. Mohtarna hamari azadi ka bahut he ghalat faeda uthai ho.” Besides that, provocative and derogatory remark on twitter, retweeted for Safoora Zargar in Aligarh zila by Computer Science Department Associate Professor, Ms.Priti Bala where she shared her expression through DR.Santosh Vyas tweet. The moment she was put on the radar for spreading defamatory offence against Safoora she presented her apologetic remark by acknowledging, sorry .Also claiming her twitter handle had been hacked which to the surprise been restored within three hours of her defamatory retweet. Nonetheless, there had been an incitement to an offense where under section 124A defines the sedition of offence of spoken, written or by visible representation which bring attempt to hatred or contempt under the constitution of India. Consequently, the Indian constitution keep a staunch track of protecting the valuable rights of every citizen like Safoora under the chapter XIV of section 295-298, chapter XVI –section-299 to 377, chapter XXI –Section-499 to 502 with respect to religious practices ,of hurt and of defamation respectively with strict course of action of violating such constitutional laws.
