Recently a Delhi based advocate Amit Dwivedi filed the petition to nationalise the health care sector of the country during COVID-19 outbreak and also to make the tests for COVID-19 free for all the citizens.
In response to that supreme Court refused to order the Government to nationalise hospitals all over the country. Moreover, they remarked the plea as "misconceived" Justice Ashok Bhushan and Ravindra S refused the plea stating "It is not a decision court can ask the government to take. We cannot order the nationalisation of hospitals. Govt has already taken over some hospitals". However, considering the second prayer of free tests for COVID-19 Justice Ashok Bhushan said to tag it with other petitions. Judge also said that "At this time everyone is doing their work. The Government is taking all kinds of effective steps for the treatment of persons infected by COVID-19".
The basis of filing the petition was the cost difference between the Government and Private Sector hospitals and that private hospitals tend to attract the people more. In addition to these concerns was the difference in the two sectors on the basis of growth as private hospitals have achieved a good amount of growth up to the date but the public health care sector lacks growth and due to the low amount spent on it by the Government by claiming that in 2020-21 budget only 1.6% is allocated for public health care which is already suffering from insufficiency.
Advocate Dwivedi also expressed his point by highlighting the fact that India has learnt from who have seen advanced to the worst stage of COVID-19 by adopting social distancing and lockdown likewise India should nationalise its hospitals during this pandemic like some other countries. If it happens in India it will be helpful for all the citizens.
